Terms of service

Draft notice: these terms are a working draft authored by the AccessiFlow team. They have not yet been reviewed by a lawyer qualified in your jurisdiction. 1. Agreement

These Terms govern your use of AccessiFlow (“the Service”), operated by DevPulse Fiji (“we”, “us”). By creating an account, installing the widget on a site you control, or paying for a subscription, you agree to these Terms.

2. The Service

AccessiFlow provides an end-user accessibility widget you embed on websites you control, plus a dashboard to configure it and analytics derived from anonymised usage beacons. Features are described on the Service’s documentation pages and may be updated over time.

3. No guarantee of WCAG / ADA / EAA compliance

The widget is an aid for visitors and does not make your website legally compliant with the Americans with Disabilities Act, the Accessible Canada Act, the European Accessibility Act, WCAG, or any other accessibility regulation. Those regimes require your underlying site to be accessible; no widget can fix semantic HTML, missing alt text, inaccessible custom components, or poor contrast in your content. 4. Your account

You must be 18 or older. You are responsible for keeping your password safe, enabling 2FA (recommended), and for all activity under your account. One account per natural person; teams should use the team invite feature.

5. Your sites + your content

You may install the widget only on sites you own or are authorised to operate. Any content you configure (site name, custom CSS, etc.) remains yours. You grant us a limited licence to host and serve that content as necessary to operate the Service.

6. Acceptable use

You agree not to

  • Abuse the widget to obscure content in ways that harm end-users
  • Circumvent the per-plan site or monthly load quotas
  • Reverse-engineer our closed-source components
  • Use the Service to ship malware, phishing, or illegal content
  • Resell the widget as your own product

7. Plans, fees, taxes

Subscriptions are billed by Paddle, our merchant of record. Paddle remits applicable VAT / sales tax. Prices are in USD. Pro-rated refunds for unused time on a plan change are at our discretion.

8. Cancellation

You can cancel any time from Billing. Cancellation takes effect at the end of the current billing period; access continues until that date. Past charges are non-refundable except as required by law.

9. Suspension + termination

We may suspend or terminate accounts for breach of these Terms, non-payment after 3 days past due, or to comply with law. We will give you at least 7 days notice except in abuse cases.

10. Warranty disclaimer

The Service is provided “as is” without warranty of any kind, express or implied. We do not warrant that it will be uninterrupted, error-free, or meet specific accessibility outcomes for any particular visitor.

11. Limitation of liability

To the fullest extent permitted by law, our aggregate liability in connection with the Service is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost revenue, lost data, or legal costs arising from accessibility litigation against your site.

12. Changes

We may update these Terms. Material changes will be announced by email and on this page at least 30 days before they take effect for existing customers.

13. Governing law

These Terms are governed by the laws of Fiji. Disputes will be settled in the courts of Suva unless applicable consumer law in your jurisdiction gives you alternative rights.
